Booking Terms and Conditions

Over yonder – Private Guided Walks

YOUR TERMS We accept bookings subject to you agreeing to the following terms and conditions set out below. Please read them carefully as they set out your respective rights and obligations. In these booking conditions, reference to ‘you’ and ‘your’ includes the first named person on the booking and all the persons on whose behalf a booking is made or any other person to whom a booking is added or transferred. If you are signing the booking form as a parent or guardian on behalf of a young person under 18 s old, you are accepting these conditions on their behalf.

MAKING A BOOKING Your booking and respective agreement will be made with us when you complete the booking form and pay us a deposit. We will issue you with a booking confirmation and additional information.

At the time of booking, along with paying your deposit you will be required to provide us with personal information such as your name, email address, phone number, next of kin and medical information.

If you wish to make a group booking for a number of people, you the first named person (the lead name) should proceed through the normal booking process. You will need to pay the deposit for group. Once the booking is complete we will provide you with an email that you must then forward to each member of the group, each participant must then complete their own booking form.

If you are a participant who is booking on to a group booking you must accept and acknowledge that your deposit has been paid for you by the first named person and all payment obligations shall exist between us and the first named person with regards your deposit. We will not process any refunds or any payments to a participant directly unless expressly agreed otherwise.

MEDICAL PROBLEMS we are open to participants of all backgrounds. If you have any medical problem, injuries or disability which may affect your involvement you must provide us with full details on the medical declaration (all such information will be dealt with in a confidential manner). Before we confirm your booking we will advise as to the suitability of your chosen outdoor activity if possible and we will endeavour to assist you.

If we reasonably feel unable to properly accommodate the particular needs of the person(s) concerned we will not confirm your booking or if details are not given at the time of booking we reserve the right to cancel your booking (imposing any applicable cancellation charges) where relevant.

COSTS – you must pay the deposit of 30% of the cost when completing the booking form. The deposit is non refundable in the event of you cancelling unless we cancel for any reason. You are advised to take out insurance when you book in order to recover payments if you have to cancel and the circumstances are covered by the insurance contract.

Any discounts and reduced pricing are applied at our discretion and are only valid for that specific activity and are not transferable.

PAYMENT you must pay the balance at least 2 weeks before the date of the activity. If you book within 2 weeks, the full cost should be paid at the time of booking.

CANCELLING YOUR BOOKING If you alter or cancel your booking after your booking has been confirmed, you must inform us as soon as possible since we may have incurred costs by this stage on your behalf.

In order to receive 100% refund you will be required to cancel your booking 2 weeks before the date of the event.

If a booking is cancelled within 2 weeks of the date of the event a £50 charge will be deducted from the refund to cover costs.

We reserve the right to cancel any booking if it is considered to be in the best interests of the group. If we need to cancel a booking for whatever reason, all monies paid to us by you will be fully refunded. We also reserve the right to make changes to routes and itineraries if circumstances dictate.

RISK HEALTH & SAFETY Over yonder will take all reasonable measures to ensure your safety however you understand fully that outdoor activities are not without risk. You therefore take part entirely at your own risk and agree to indemnify us against claims for loss or damage to personal property or for loss or consequential losses or claims through your participation in the activity arising from your own actions. The idea of this type of activity is one which allows alternatives and a substantial degree of flexibility. Itineraries given must therefore betaken as an indication and not as a contractual obligation on our part. You must be adequately fit to cover the distances set out in your itinerary. If it is felt that any client is not sufficiently fit, healthy, properly equipped or able to complete the activity without affecting its safety, comfort or progress, the leader at any stage has the right to terminate the activity in order to ensure the safety of the group.

PARENTAL RESPONSIBILITYChildren under the age of 18 are only accepted by prior agreement.. Any people under the age of 18 must be accompanied by their parents or legal guardians who agree to take full responsibility for their actions and safety and supervision of them at all times. This means people under 18 years being within sight and sound of their parent or legal guardian and under their control at all times.

For any child under 16 the information provided on the booking forms and the declarations below must be provided and signed for by the child’s parent or legal guardian. In providing and signing for this information you are confirming that the information is correct, that you will ensure that your child understands, as far as reasonably practicable, and is aware of the information provided, as well as the description and risks of the activity. You also confirm that your child has the relevant fitness and/or experience to participate in the activity and that you accept the risks for your child and give consent for them to take part.

INSURANCE Over yonder has full public and professional liability insurance, and we advise you to take out your own personal accident and liability insurance and appropriate cancellation insurance.

Our website, social media, emails and printed materials are accurate to the best of our knowledge and produced in good faith. Clients must have a good written and spoken understanding of English so as to understand the information and risks of their activity and information or guidance provided by the walk leader on the day. Over yonder can not take responsibility for any misunderstandings resulting from a client not reading or understanding this information. Over yonder can not accept responsibility for any loss or damage to your personal effects, property or vehicles during an activity.

BAD WEATHER AND OTHER EXTERNAL FACTORS Activities will generally take place regardless of the weather on the day unless the leader considers that conditions could compromise the safety of the group. No refunds will be made if a client decides to cancel as a result of weather conditions on the day.

Other factors such as, landslides, flooding, footpath and rights of way restrictions or erosions can also impact the ability to undertake a planned itinerary. As a result, changes may need to be made at the leader’s discretion. We reserve the right to make changes to the itinerary or to cancel the booking where appropriate for safety reasons.

BEHAVIOUR You must comply with the laws and regulations of this country. You must comply with all reasonable instructions of the walk leader relating to the safety and organisation of the activity. If in our opinion the leader feels that you are behaving in such a manner as to cause danger, distress or annoyance to others or cause damage to property, your contract may be terminated by us. In such an event we shall have no liability to you and will not be responsible for making any refunds, paying any compensation or meeting any costs or expenses you incur as a result. Furthermore you agree to indemnify us for the full amount of any claim (including legal costs) made against us by any third party or any costs that we incur because of your conduct.

Alcohol and other intoxicants are not allowed to be consumed during the walk. If you are intoxicated it could mean that the event will be cancelled.

DOGSIf you wish to bring a dog then please advise us of this prior to booking so we can discuss whether this can be accommodated.

MEDIA you give your consent that any photography, stills or video recordings made during the activity which may include you in it may be used in publicity material on our website, social media or other promotional material from time to time, and that we will retain all rights title and interest in such photography or media made by us including but not limited to any benefits and proceeds derived from such material.

DOCUMENTATION please contact us immediately if any of the information you receive from us appears to be incorrect or incomplete. We regret that we can not accept responsibility if you do not tell us about any mistakes in any documentation. We will do our best to rectify any mistake notified to us.

COMPLAINTS we will do our best to ensure that yourarrangements go according to plan. However if you have a complaint arsing out of what we have agreed to provide for you please let us know at your earliestopportunity. It is important that you advise the walk leader who will endeavour to put things right. If the situation is not resolved you should contact us within 28 days in writing with all the relevant information. Your letter will be given prompt attention and we will reply to you within 28 days. If you fail to follow this procedure we can not accept responsibility as we would have been deprived of the opportunity to investigate the matter and hopefully rectify any problem. Failure to complain may affect your rights under this contract.
